Contest Rules

This document governs the video contests (the "Contests") organized through the InOnda WebTv platform (webtv.inonda.tv), managed by GiaNet Media of Francesco Giannetta, part of the Trovido network. Each Contest is promoted and organized by a channel registered on the platform (the "Organizer"); the specific regulations of each Contest (prizes, criteria, deadlines) are published on the individual Contest page and prevail, for specific aspects, over these general regulations.
1. Nature of the platform
InOnda WebTv exclusively provides the technical tools (uploading, publishing via embed, vote collection) for managing Contests. The platform is neither the producer nor the publisher of the content uploaded by participants, which remains user-generated content (UGC). Videos are hosted on YouTube – in "unlisted" mode unless otherwise chosen by the Organizer – and reproduced via embed.
2. Organizer's Responsibility
The Organizer is solely responsible for the Contest promoted by them, including the definition and legitimacy of the specific regulations, prize management, content moderation, and compliance with applicable regulations (in particular, where applicable, the discipline of prize events pursuant to D.P.R. October 26, 2001, no. 430). By creating the Contest, the Organizer declares to assume all responsibility and indemnifies and holds harmless webtv.inonda.tv, GiaNet Media, and Trovido from any claim, complaint, cost, or liability whatsoever connected to the Contest and the content uploaded by participants.
3. Participant's Responsibility — Release
By submitting a video, the Participant declares and guarantees, under their sole responsibility:
- to be the holder of all rights (copyright, related rights, image rights) on the video and on each of its components, including music and footage of people, or to have acquired the necessary authorizations and releases;
- that the video does not violate third-party rights or legal provisions and does not contain defamatory, obscene, discriminatory, or otherwise unlawful content;
- to indemnify and hold harmless the Organizer, webtv.inonda.tv, GiaNet Media, and Trovido from any third-party claims.
The Participant grants the Organizer and the platform a non-exclusive and free license, for the duration of the Contest, for the purpose of publishing and reproducing the video within the Contest.
4. Copyright and Music (SIAE)
The Participant is solely responsible for the presence of protected works in the video, particularly musical pieces. The use of third-party music requires the necessary licenses. The hosting of videos on YouTube is subject to YouTube's agreements and policies, including those with collective management organizations (SIAE). The platform does not issue any SIAE license on behalf of participants or Organizers.
5. Voting
Voting is reserved for registered and authenticated users; email address verification and limits on the number of votes may be required to prevent fraud. The platform and the Organizer may cancel suspicious or irregular votes and disqualify non-compliant entries.
6. Personal Data
The data of participants and voters are processed in accordance with the platform's Privacy Policy and, where applicable, of the Organizer as data controller or joint controller for the purposes of the Contest, in compliance with Regulation (EU) 2016/679 (GDPR).
7. Content Removal
The platform and the Organizer may remove content that violates these regulations or is reported as unlawful at any time, including following requests from rights holders (notice and take down procedure).
